1. Acceptance of Terms
By requesting and using the services of Luxury Logistics
International (hereinafter, "the Company"), you
(hereinafter, "the Client") agree to be bound by these Terms and
Conditions in their entirety. If you do not agree with any of these
terms, do not use our services.
2. Booking and Confirmation
- Booking Request: Reservations can be made
through our website, email, or by phone. The Client must provide
accurate and complete information about the requested service,
including date, time, pickup location and destination, number of
passengers, and any special requirements.
- Booking Confirmation: The booking is considered
confirmed once the Company has sent a written confirmation
(email or message) to the Client, indicating the service details
and the agreed price. The Company reserves the right to reject a
booking request.
- Booking Modifications: Any changes to the
booking (date, time, destination, etc.) are subject to
availability and may incur additional charges. Modification
requests should be made as early as possible and will be
confirmed in writing by the Company.
3. Prices and Payments
- Rates: Our service prices are based on factors
such as distance, estimated travel time, the type of vehicle
selected, and any additional services requested. Current rates
will be communicated to the Client at the time of booking.
- Additional Charges: Additional fees may apply
for excessive waiting time, unplanned extra stops, tolls,
parking, excess luggage, or special vehicle cleaning due to the
Client’s actions.
- Payment Methods: We accept various payment
methods, which will be specified at the time of booking. Full
payment or a deposit may be required to confirm the reservation.
- Invoicing: A detailed invoice will be provided
to the Client upon completion of the service, if requested.
- Taxes: The stated prices may be subject to
applicable taxes, which will be specified in the booking
confirmation and the invoice.
4. Cancellations and Refunds
- Cancellation by the Client: Cancellation
policies and any associated fees will vary depending on the type
of service and the notice given. Specific details will be
communicated to the Client at the time of booking. Late
cancellation fees may apply.
- Cancellation by the Company: The Company
reserves the right to cancel a reservation due to unforeseen
circumstances beyond its control (e.g., extreme weather
conditions, mechanical failures, traffic incidents, etc.). In
such cases, the Client will be offered a full refund or
rescheduling of the service, subject to availability.
- Refunds: Refunds, if applicable, will be
processed within a reasonable time frame using the same payment
method used for the original booking.
5. Client Conduct
- The Client agrees to behave respectfully and appropriately
during the service.
- Smoking, illegal drug use, or excessive alcohol consumption is
not permitted inside the vehicles.
- The Client will be responsible for any damage to the vehicle
caused by their negligence or inappropriate behavior.
- The Company reserves the right to terminate the service without
refund if the Client’s behavior is deemed unacceptable or poses
a risk to the driver or the vehicle.
6. Liability
- The Company will strive to provide the service in a punctual and
safe manner. However, it is not responsible for delays caused by
circumstances beyond its control (e.g., traffic, accidents,
weather conditions, etc.).
- The Company's liability for any direct loss or damage caused by
proven negligence will be limited to the amount of the
contracted service price.
- The Company is not liable for any indirect, incidental, special,
or consequential loss arising from the use of its services.
- The Client is responsible for the safety of their personal
belongings during the service. The Company is not responsible
for the loss or damage of such items.
7. Service Exclusivity
The Company reserves the right to determine the exclusivity of the
service provided. Unless otherwise agreed in writing, other
passengers may be included in the vehicle during the transfer.
8. Personal Data Protection
The Company collects and processes the Client's personal data in
accordance with its Privacy
Policy, available on its website. By using our
services, the Client consents to the processing of their personal
data in accordance with this policy.
9. Intellectual Property
All intellectual property rights related to the Company, its website,
logos, and promotional materials are the exclusive property of the
Company.
10. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and interpreted in
accordance with the laws of Peru. Any disputes
arising in connection with these terms shall be submitted to the
exclusive jurisdiction of the courts of Peru.
11. Amendments to Terms and Conditions
The Company reserves the right to amend these Terms and Conditions at
any time without prior notice. Modifications will take effect upon
their publication on the Company’s website. Clients are encouraged
to review the Terms and Conditions periodically.
